Terms of Use

1. Acceptance of Terms

These Terms of Use ("Terms") govern your use of Kylin ("the App"), an app that teaches Mandarin Chinese on the HSK 3.0 syllabus, published by IOCODO LLC ("we", "our", "us"). By downloading, installing or using the App, you agree to be bound by these Terms. If you do not agree, do not install or use the App.

If you obtained the App from the Apple App Store, the Apple Standard End User License Agreement (EULA) also applies to your use of the App. Where these Terms and the Apple Standard EULA conflict, the Apple Standard EULA governs for installations obtained through the App Store.

2. License

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for personal, non-commercial learning.

You may not:

• Reverse engineer, decompile, or attempt to extract the source code, except where local law expressly permits
• Modify, redistribute, sublicense, rent, lease, or sell the App or any part of it
• Remove or obscure copyright, trademark, or other proprietary notices, including the third-party attributions in Section 7
• Use the App in a way that violates applicable law or these Terms

3. Free and Paid Content

The App uses a freemium model:

• Free: the whole of HSK 1, meaning its 300 words, its 246 characters with stroke practice, its grammar and its reader, together with spaced-repetition review of everything you learn there.
• Kylin Pro: opens HSK 2 and HSK 3, adding 711 further words and 409 further characters, with their grammar and reading.

Levels above HSK 3 are not part of the App today. If we add them, we will say clearly in the App and on the store listing whether they are included in an existing purchase.

4. Subscriptions and In-App Purchases

Kylin Pro is available as the following products, sold and billed by the Apple App Store or Google Play:

• Kylin Pro Monthly: an auto-renewing subscription billed once per month.
• Kylin Pro Annual: an auto-renewing subscription billed once per year, which may include an introductory offer.
• Kylin Lifetime: a single one-time purchase that opens Kylin Pro permanently and does not auto-renew.

The price, billing period and any introductory offer are shown in the App in your local currency before you confirm a purchase. Prices vary by storefront.

Auto-renewal terms (subscriptions):

• Payment is charged to your Apple App Store or Google Play account at confirmation of purchase.
• A subscription automatically renews for the same period unless you cancel it at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours before the end of the current period, at the price of the chosen plan.
• You can manage or cancel a subscription at any time in your device account settings (Apple: Settings › your name › Subscriptions; Google Play: Play Store › Subscriptions). Cancellation takes effect at the end of the current billing period.
• Any unused portion of an introductory offer is forfeited when you purchase a subscription, where applicable.

Restoring purchases: if you reinstall the App or change devices, use Restore purchases on the upgrade screen to restore your existing entitlement.

Refunds are handled by the platform you purchased from, under Apple's or Google's respective policies. We do not separately process payments and cannot issue platform refunds directly.

5. Accounts

The App does not require you to create an account or provide personal information to learn. To back up your learning progress, the App signs you in anonymously, and you can optionally link an Apple or Google account to carry that progress to another device. Your purchase entitlement is tied to your Apple App Store or Google Play account, not to any account we hold. See our Privacy Policy for details on data handling, and the account deletion page for how to remove your account.

6. Intellectual Property

The App, including its code, lessons, mnemonics, art, audio and design, is owned by IOCODO LLC and protected by copyright and other intellectual property laws. All rights not expressly granted to you in these Terms are reserved. Section 7 sets out the third-party material the App includes under separate licences.

7. Third-Party Content and Attribution

The App includes reference material from open projects, reproduced under their own licences. The full licence text of each ships inside the App, on its attribution screen:

• CC-CEDICT, used for Chinese to English definitions and readings, under Creative Commons Attribution-ShareAlike 4.0.
• Make Me a Hanzi, used for stroke order and character decomposition. Copyright 1999 Arphic Technology Co., Ltd. and copyright 2016 Shaunak Kishore, distributed under the Arphic Public License.

Those licences govern that material, and nothing in these Terms restricts the rights they grant you in it.

8. Learning Content and the HSK Syllabus

Kylin follows the HSK 3.0 syllabus, the standard published by the Chinese Language Education and Cooperation Centre. IOCODO LLC is an independent developer. Kylin is not affiliated with, endorsed by, or certified by the Chinese Language Education and Cooperation Centre, Hanban, Confucius Institute Headquarters or any HSK examination body, and no part of the App is an official exam product.

Our lessons are prepared with care, but language learning involves judgement and the App is a study aid, not a guarantee of any specific result, HSK exam result included. If you spot a mistake, report it in the App ("Something looks wrong?") and we will review it.

9. Updates

We may release updates that fix bugs, add content or levels, and change features. Updates are delivered through the Apple App Store or Google Play. Some updates may be required to keep the App working correctly.

10. Disclaimer of Warranties

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will be uninterrupted, error-free, or compatible with every device.

11. Limitation of Liability

To the fullest extent permitted by applicable law, IOCODO LLC shall not be liable for any indirect, incidental, consequential, special or exemplary damages arising out of or in connection with your use of the App, including loss of progress or data. Our total liability shall not exceed the amount you paid, if any, for the App or Kylin Pro in the twelve months preceding the claim.

12. Termination

These Terms remain in effect while you use the App. You may terminate at any time by uninstalling the App. We may suspend or terminate your license if you breach these Terms. Termination does not entitle you to a refund of any subscription period already paid.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date at the top of this page. Continued use of the App after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which IOCODO LLC is established, without regard to its conflict-of-laws principles. Where local consumer-protection law gives you stronger rights, those rights prevail.
