Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and IOCODO LLC ("we", "us", "our"), operator of SoliDuel, governing your access to and use of the SoliDuel application and related online services (the "Service"). By accessing or using the Service, you accept and agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. Definitions
- Service: SoliDuel is a real-time multiplayer solitaire card game. The term "Service" means the SoliDuel application (mobile and web), its features, and any related online infrastructure and content we provide.
- Content: any text, usernames, in-game communications, or other materials you submit or generate through the Service.
- User: any person who accesses or uses the Service.
2. Eligibility
To use the Service, you must be at least 13 years of age (or the applicable minimum age in your jurisdiction, including 16 where required by law) and have the legal capacity to enter into a binding agreement (or, if you are under the age of majority, the consent of a parent or guardian where the law of your country requires it). By using the Service, you represent and warrant that you meet these requirements. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms. The Service is not directed to children below the applicable minimum age; we do not knowingly collect personal data from such users (see our Privacy Policy).
United States. Parental control protections, such as devices, software and filtering services, are commercially available and may help you limit a minor's access to harmful material. Current providers include Apple, with Screen Time on iPhone and iPad, and Google, with Family Link on Android.
3. Accounts
You may create or access an account using supported sign-in providers (e.g. email, or third-party identity providers). You are responsible for: (a) providing accurate and complete information; (b) maintaining the confidentiality of your credentials; and (c) all activity that occurs under your account. You must notify us promptly of any unauthorised use. We reserve the right to refuse or suspend accounts that do not comply with these Terms or that we reasonably believe are used for abuse or fraud. You may delete your account at any time via Settings → Delete Account.
4. Acceptable use
You agree to use the Service only in accordance with these Terms and applicable laws. You must not:
- use the Service for any illegal or unauthorised purpose, or in any way that violates the rights of others;
- engage in cheating, manipulation of game systems, use of unauthorised automation, or other conduct that undermines fair play;
- harass, threaten, defame, or impersonate any person or entity;
- spam, distribute malware, or interfere with the integrity or availability of the Service or its infrastructure;
- scrape, copy, or reverse-engineer the Service (or any part of it) except as permitted by mandatory law;
- use the Service to transmit any Content that is unlawful, harmful, obscene, or otherwise objectionable.
We may suspend or terminate your access and take such other action as we deem appropriate in the event of a breach of this section or of these Terms generally.
5. Content rules and moderation
We have zero tolerance for objectionable content or abusive behaviour. These rules apply to everything you write or choose in SoliDuel: usernames, avatars and chat messages. We apply them in the same way to everyone.
What is not allowed
- Child sexual abuse and exploitation. Any content or conduct that sexualises a minor, asks a minor for sexual content or contact, or tries to win a minor's trust for that purpose. We remove it as soon as we become aware of it, close the account and report it to the National Center for Missing & Exploited Children (NCMEC) or to the competent authority.
- Terrorism. Content that promotes or praises terrorist acts, or helps to prepare them.
- Other illegal content, including threats, harassment, hatred of a person or a group, fraud and scams, and intimate images or sexual content shared without consent.
- Abusive, obscene or hateful content, even where it is not against the law, and attempts to draw players to other apps to ask them for money, personal details or intimate content.
How we moderate
- The chat is text only. Images, files and voice messages cannot be sent. Before your first chat with a player, the app asks whether you want to start it.
- Your tools. In the app you can report a chat with Report chat, block a player and mute a player's chat. Once you block a player, you stop seeing their messages at once.
- An automated check. When a match ends, software looks through its chat for fixed word patterns typical of scams. It decides nothing: a match creates a report for our team.
- A filter on usernames. Each time a username is saved, software compares it with a list of words that are sexual, insulting or hateful, or that encourage self-harm. A name the filter refuses cannot be saved. If a name already saved breaks these rules, we may replace it with a neutral one, and you can choose a new name at once. If you think a name was refused or replaced by mistake, write to support@iocodo.com.
- A first read by software. When a player reports a chat, an AI service (Gemini, by Google) reads it and writes a suggestion for our team, but only if every other person who wrote in that chat agreed to this before chatting. It never reads a report of intimate content shared without consent. It decides nothing.
- Review by a person. A person on our team reads every report, normally within 24 hours, and decides. We act in the same way when we learn about illegal content by any other means. Software decides on its own in two cases only: the username filter, and a player in Brazil reporting a chat for intimate content shared without consent. In the second case, the other player's username is replaced at once with a neutral one, and their messages in that chat are hidden from everyone until a person has reviewed the report.
- What we do. We remove content that breaks these rules when we see it or when it is reported to us. We may also restrict the chat for a time or for good, suspend or close the account and, where the law requires it, inform the authorities. For users in the United Kingdom: intimate content shared without consent is removed within 48 hours of the report.
If you disagree with a decision
When we restrict your chat or your account, the app tells you. If you think a decision is wrong, whether it restricted you or it concerned a report you sent, write to support@iocodo.com. A person looks at the case again and answers you by email.
Reporting from outside the app
Anyone, player or not, can report illegal content with our report form, which gives a reference for the report, or by writing to support@iocodo.com. The same address is our contact for child safety.
6. Content and licence grant
You retain ownership of the Content you submit. By submitting Content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable licence to use, store, reproduce, modify (as necessary to operate the Service), display, and transmit such Content solely for the purpose of providing and improving the Service. You represent and warrant that you have all rights necessary to grant this licence and that your Content does not infringe any third-party rights. We do not claim ownership of your Content, but we may retain copies as needed for the operation of the Service, to comply with law, or to enforce these Terms, in accordance with our Privacy Policy.
7. Intellectual property and our materials
The Service, including but not limited to its software, design, text, graphics, logos, and other materials we provide, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your personal, non-commercial use in accordance with these Terms. You may not copy, modify, distribute, sell, or create derivative works based on the Service or our materials without our prior written consent, except where expressly permitted or where mandatory law allows.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DEFECTS WILL BE CORRECTED. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM US OR THROUGH THE SERVICE WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED HEREIN. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES; IN SUCH CASES, THE ABOVE EXCLUSIONS APPLY TO YOU ONLY TO THE EXTENT PERMITTED BY LAW.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE (AND OUR AFFILIATES, LICENSORS, AND SERVICE PROVIDERS) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED EUROS (€100), WHICHEVER IS GREATER. NOTHING IN THESE TERMS EXCLUDES OR LIMITS OUR LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, FRAUD, FRAUDULENT MISREPRESENTATION, OR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW. CONSUMERS IN THE EUROPEAN ECONOMIC AREA AND OTHER JURISDICTIONS WITH MANDATORY CONSUMER PROTECTION LAWS MAY HAVE ADDITIONAL RIGHTS THAT CANNOT BE WAIVED BY CONTRACT; THESE TERMS DO NOT AFFECT SUCH RIGHTS.
10. Indemnification
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless us and our affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your Content; (b) your violation of these Terms or applicable law; or (c) your violation of any third-party rights, except to the extent caused by our own fault. We reserve the right to assume the exclusive defence and control of any matter subject to indemnification by you, at your expense.
Consumers in the EU, the EEA, Switzerland, the United Kingdom and Brazil
If you use SoliDuel as a consumer and live in one of these places, sections 8, 9 and 10 do not apply to you. The points below apply, and they prevail over anything else in these Terms:
- If you live in the EU, the EEA, Switzerland or the United Kingdom, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or of our failing to use reasonable care and skill. In those places, we are not responsible for loss or damage caused by events outside our reasonable control.
- Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, for wilful misconduct or gross negligence, or any other liability that the law of your country does not allow us to limit.
- You do not have to indemnify us. You are responsible only for loss you cause by breaking these Terms or the law, as the law of your country provides.
- If you live in the EU, we close your account, or end your access to the Service, only after telling you a reasonable time in advance, unless there are serious grounds to act at once, for example a serious or repeated breach of these Terms or of the law, the need to prevent fraud or harm to others, or a requirement of the law or of an authority. When we suspend or close your account, we tell you why no later than when we do it, unless the law does not allow it. If we stop providing the Service, we give you reasonable notice.
- If you live in Poland, we suspend or close your account, or your access to the Service, only if you seriously or repeatedly break these Terms or the law, if we need to prevent fraud or harm to others, or if the law or an authority requires it. Before we close your account, we tell you and give you the reason, unless the law, a risk of harm or the security of the app prevents it. Where sections 3, 4 and 11 say otherwise about suspending or closing an account, these two points apply.
- If you live in Poland, we transfer this agreement, or our obligations to you, to another company only with your consent. If you live elsewhere in the EU, we may transfer this agreement to another company, for example if SoliDuel is sold, as long as your rights are not reduced. Where the Assignment clause in section 13 says otherwise, this point applies.
- The rights that the law of your country gives you as a consumer stay as they are.
11. Termination
You may terminate your use of the Service at any time by ceasing use and, where applicable, deleting your account. We may suspend or terminate your access to the Service, or delete your account, at any time, with or without notice, for any reason, including if we believe you have breached these Terms or applicable law, or if we discontinue or materially modify the Service. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including, without limitation, Sections 6 to 10 and this sentence) shall survive. We may retain and use your information as described in our Privacy Policy.
12. Changes to the Terms
We may change these Terms when the law changes, when SoliDuel or the services it relies on change, or to make the Terms clearer. We tell you about a change in advance, in the app or by email if your account has an address, and the date at the top of this page shows the version in force. If you do not agree with a change, you can stop using SoliDuel and delete your account at any time, in Settings, with Delete Account.
13. General
- Governing law: These Terms are governed by the laws of your country of residence, except that (i) to the extent you are a consumer, the mandatory consumer protection laws of your jurisdiction apply, and (ii) where permitted, we may choose to apply the laws of a specific jurisdiction for non-consumer users. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
- Disputes: Any dispute arising out of or relating to these Terms or the Service shall be resolved in the courts of your jurisdiction to the extent required by mandatory law.
- Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
- Entire agreement: These Terms, together with our Privacy Policy and any additional terms we may present for specific features, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
- Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
- Assignment: You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations without restriction.
