These Terms are an agreement between you and IOCODO LLC ("we", "us") about your use of the Quarko mobile application and everything in it (the "App"). By downloading, opening, or using the App you accept these Terms. If you do not accept them, do not use the App.
The App is also subject to the rules of the store you obtained it from, Apple's App Store or Google Play. Where a store rule conflicts with these Terms, the store rule applies to that part.
Quarko is suitable for all ages and asks for no personal information. If you are under the age at which you can enter a binding agreement where you live, you may use the App with the involvement of a parent or guardian, who accepts these Terms on your behalf. A purchase made on a device you do not own or control needs the account holder's permission.
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own non-commercial use. This licence is what you receive; the App itself is licensed, not sold.
You may not: copy, sell, rent, sublicense, or redistribute the App; reverse engineer, decompile, or disassemble it except to the extent that applicable law expressly permits; remove or alter any notice of ownership; use the App to break the law; or use automated tools to interfere with how it works.
Quarko contains twelve puzzle games, each with a level campaign and three Endless difficulties, plus a Daily Observation, a streak, hints, achievements and a progress map. Puzzles are generated and checked on your device, so the games work without a connection.
Game content, level design and difficulty may change between versions as we improve the App. We may add, alter or retire a feature, and we may end support for older operating system versions.
Quarko Complete is a single optional one-time purchase. It lifts the limit on hints and doubles the daily reward. It is not required to play any game, to finish any level, or to complete the campaign.
The unlock is tied to the store account that bought it, not to a Quarko account, because Quarko has no accounts. You can bring it back on another device signed into the same Apple or Google account with the "Restore Purchases" action in the App.
Quanta are an in-game currency used to pay for hints. Quanta, stars, streaks and achievements:
Quanta are earned by playing. They are not sold, and nothing in the App can be bought with real money except Quarko Complete.
All purchases are processed by Apple or Google under their own terms and their own payment methods. We never see or hold your payment details.
Refunds are therefore handled by the store, not by us. Ask Apple through reportaproblem.apple.com, or Google through the Play Store order history. If you are a consumer in the European Union, the United Kingdom, or another place with a statutory withdrawal right, that right applies through the store as well. We are happy to help you make the case, but we cannot issue the refund ourselves.
Prices are shown by the store in your local currency and may change over time.
Your gameplay lives on your device. It is not backed up to a server of ours, so deleting the App or losing the device loses the progress with it. Anonymous measurement and crash reporting are described in the Privacy Policy, which forms part of these Terms.
The App fetches a small settings file so we can correct a broken feature or post a service notice without waiting for a store update. That mechanism is used to keep the App working, never to take away access to a game you already have.
Use the App as it was meant to be used. Do not attempt to modify saved data, patch the binary, or otherwise fake purchases, progress or achievements. Do not attempt to disrupt the services the App depends on. We may stop supporting an installation that is used this way.
The App, its games and their names, its artwork, sounds, text, level designs and code, and the Quarko name and logo, belong to IOCODO LLC or its licensors and are protected by copyright and trade mark law. The scientific and mathematical ideas the games are built on are of course free to everyone; our expression of them is not.
Screenshots and recordings for reviews, videos, articles or social posts are welcome, with attribution to Quarko.
We try to keep the App working on current devices, but we do not promise that it will be free of errors, or that it will remain available in every country or on every store. Store distribution can change for reasons outside our control.
The App is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, to the fullest extent permitted by applicable law. We do not warrant that the App will be uninterrupted, error-free or secure, or that any defect will be corrected. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, lost progress or lost profits, arising out of your use of or inability to use the App. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us for it or twenty euros (€20).
Nothing here excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be excluded under applicable law. Consumers with mandatory statutory rights keep those rights in full.
We may update these Terms as the App changes. The current version is always at this URL with its effective date at the top. Continuing to use the App after an update means you accept the new version. If a change is significant, we will say so in the App.
You may end this agreement at any time by deleting the App. We may suspend or end your licence if you break these Terms in a material way. Sections 6, 10, 12, 13 and 16 survive the end of this agreement.
These Terms are governed by the laws of the jurisdiction in which IOCODO LLC is established, without regard to its conflict-of-laws principles. Where local consumer-protection law gives you stronger rights, those rights prevail.
Apple and Google are not parties to these Terms and are not responsible for the App or its content. They have no obligation to provide support for the App. If the App fails to conform to a warranty that applies, you may notify Apple, which may refund the purchase price; beyond that, Apple has no other warranty obligation. Apple and Google are third-party beneficiaries of these Terms and may enforce them against you.
